Terms of Service

These Terms of Service (“Terms”) govern your use of the ODyn platform operated by Ocular Dynamics LLC (“ODyn,” “we,” “us”). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. The Service
ODyn is an informational data-correlation platform that allows users to record and organize health-adjacent observations and measurements, scan product labels for ingredient analysis, follow structured spike-tracking workflows, and view individual and aggregate insights. ODyn is not a medical device, does not provide medical advice, diagnosis, or treatment, and does not replace consultation with a qualified ophthalmologist or other healthcare provider.
2. Eligibility & Accounts
You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly via our contact form if you suspect unauthorized access.
3. Subscriptions & Billing
Paid subscriptions automatically renew on the monthly or annual interval selected at checkout unless canceled before the end of the current billing period. You may cancel at any time through your Account page. If you subscribed online, you may cancel online. Cancellation stops future renewal charges but does not retroactively refund the current billing period, except where required by law. We may change subscription pricing prospectively, but any price change will be communicated in advance and will apply only to future billing periods.
Founding member pricing, when offered, remains in effect only while the applicable subscription remains continuously active and in good standing. If the subscription lapses, is canceled, or payment fails and is not timely cured, the founding-member rate may be forfeited.
4. Medical Disclaimer
ODyn is not a medical device. The content, correlations, spike alerts, and educational material provided by the service are for informational purposes only and are not a substitute for professional diagnosis, treatment, or advice. Never disregard professional medical advice or delay seeking it because of something you read or were shown on ODyn. In an emergency (sudden vision loss, severe eye pain, persistent elevated IOP), contact your ophthalmologist or emergency services immediately.
Any correlations, alerts, rankings, or educational content provided through the service are probabilistic and informational only, may be incomplete or inaccurate for your circumstances, and should not be used as the sole basis for medical decisions.
5. Acceptable Use
You agree not to:
- Submit false, misleading, or deliberately corrupted data (fake IOP readings, fabricated product scans, etc.) that could distort the community dataset
- Scrape, reverse engineer, or attempt to extract the aggregate dataset, ontology tables, or proprietary correlation logic
- Use the service to provide medical advice to others, run a commercial health service, or act on behalf of a covered entity without a prior written agreement with us
- Upload images that are not product labels you are personally examining, or images that contain personal information of other individuals
- Interfere with the platform's operation, bypass security or rate limits, or exploit vulnerabilities
- Share your account with others or permit others to access the service through your credentials
- Use the service or its outputs to train, benchmark, or improve any competing product, model, or dataset without our prior written consent
- Upload material that infringes intellectual property, privacy, or publicity rights
6. Your Data
You retain rights in the personal data and content you submit, subject to the rights you grant in these Terms. You grant ODyn a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, analyze, and display your submitted data solely to operate, maintain, improve, and provide the service, enforce these Terms, and generate de-identified and aggregated insights as described in our Privacy Policy and Consumer Health Data Privacy Policy. De-identified and aggregated outputs that are no longer reasonably linkable to you may be retained and used after account deletion.
7. Intellectual Property
Third-party datasets, ontologies, and service components remain subject to their respective terms and licenses. As between you and ODyn, ODyn retains all rights in the platform, its design, selection, arrangement, correlation methods, and aggregate outputs, except as otherwise required by law. The ODyn name and logo are trademarks of Ocular Dynamics LLC.
8. Third-Party Services
ODyn relies on third-party providers to operate certain parts of the service, including hosting, storage, authentication, billing, and ingredient-processing functions. We are not responsible for outages, interruptions, or failures caused solely by third-party services beyond our reasonable control, although we may work with providers to address such issues.
9. Warranty Disclaimer
The service is provided “as is” and “as available.” To the fullest extent permitted by law, ODyn disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that correlation insights will be clinically actionable for any individual case.
10. Limitation of Liability
To the fullest extent permitted by law, and except for liability that cannot be limited or excluded under applicable law, Ocular Dynamics LLC, its officers, members, employees, and affiliates are not liable for any indirect, incidental, consequential, or punitive damages, or for loss of profits, data, use, or goodwill, arising from or related to your use of the service. Our total aggregate liability for any claim arising out of these Terms or the service is limited to the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) one hundred U.S. dollars.
11. Indemnification
You agree to defend, indemnify, and hold harmless Ocular Dynamics LLC and its affiliates from third-party claims, damages, liabilities, and expenses arising from your breach of these Terms, misuse of the service, submitted content, or violation of applicable law or third-party rights.
12. Termination
You may delete your account at any time from your Account page. We may suspend or terminate your account for violation of these Terms, fraud, or other conduct that harms the service or other users. We may also terminate or suspend the service, or portions of it, for extended inactivity or upon discontinuation of the service.
Termination or deletion does not affect our rights to retain or use data where permitted under our Privacy Policy or Consumer Health Data Privacy Policy, including de-identified and aggregated data. Sections on medical disclaimer, your data, intellectual property, warranty disclaimer, limitation of liability, indemnification, and governing law survive termination.
13. Changes
We may update these Terms from time to time. If we make material changes, we will provide notice in-app, by email, or both, and identify the updated effective date. By continuing to use the service after the effective date of the revised Terms, you agree to the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service shall be brought exclusively in the state courts located in Denver County, Colorado, or the United States District Court for the District of Colorado, and you consent to the personal jurisdiction of those courts, except where applicable consumer-protection law requires otherwise.
